Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Cash's Tire Recycling Inc("Company," "we," "us," or "our"), a TCEQ-registered waste tire processing and storage facility operating in the State of Texas. These Terms govern your use of our website at cashstirerecycling.com, as well as all services provided by the Company, including but not limited to tire pickup, disposal, recycling, transportation, casing purchasing, and used tire sales.

IMPORTANT: PLEASE READ THESE TERMS CAREFULLY.

By requesting, scheduling, or accepting any services from Cash's Tire Recycling Inc, submitting a contact form on our website, placing an order, or otherwise engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use our website or services. These Terms contain important provisions regarding limitation of liability (Section 10), dispute resolution (Section 14), and binding arbitration (Section 15).


1. Services Provided

Cash's Tire Recycling Inc provides the following services in the Houston, Texas metropolitan area and surrounding regions:

  • Tire Disposal & Removal: Pickup and lawful disposal of scrap, junk, and waste tires from commercial and residential locations
  • Tire Recycling: Processing of scrap tires into recycled materials including crumb rubber, rubber mulch, and tire-derived fuel at our TCEQ-registered facility
  • Tire Casing Purchasing: Inspection, evaluation, and purchase of retreadable commercial tire casings from tire shops, trucking companies, fleet operators, and other sources
  • Used Commercial Tire Sales: Sale of retreaded (recap) commercial truck tires, primarily in 11R 22.5, 295/75R22.5, 11R 24.5, and 275/80R22.5 sizes
  • Tire Transportation & Hauling: Commercial tire pickup, delivery, and hauling services across the Houston area and State of Texas

All services are subject to availability, scheduling, and the terms set forth in any separate written service agreement or contract executed between the parties.


2. Regulatory Compliance & Licensing

Cash's Tire Recycling Inc operates in compliance with all applicable federal, state, and local regulations governing waste tire management, including but not limited to:

  • Texas Commission on Environmental Quality (TCEQ): We are a registered waste tire processor and storage facility under 30 Texas Administrative Code (TAC), Chapter 328 (Waste Tire Management). TCEQ Registration No.: [TO BE PROVIDED]
  • Texas Health & Safety Code: Compliance with Chapter 361 (Solid Waste Disposal) and Chapter 371 (Used Oil and Waste Tire Recycling)
  • City of Houston Permits: Valid operating permits issued by the City of Houston. Permit No.: [TO BE PROVIDED]
  • U.S. Department of Transportation (DOT): All retreaded tires sold by the Company meet applicable DOT safety standards
  • Federal Motor Carrier Safety Administration (FMCSA): Transportation services comply with applicable FMCSA regulations for commercial vehicle operations

Important Regulatory Notice

Illegal tire dumping in Texas is a criminal offense under Texas Health & Safety Code §361.112 and can result in fines of up to $50,000 per day per violation, criminal prosecution, and civil liability. By using our services, you are ensuring lawful disposal of waste tires through a registered facility. We maintain complete waste tire manifests and chain-of-custody documentation for all tires processed at our facility, available to customers and regulatory agencies upon request.


3. Service Requests & Scheduling

  • 3.1 Service requests may be made via phone ((832) 864-7067), text message (SMS), email (cashstirerecycling@gmail.com), or through the contact form on our website.
  • 3.2 All service requests are subject to confirmation by our team. A service request does not constitute a binding agreement until confirmed by Cash's Tire Recycling Inc in writing, verbally, or via text message.
  • 3.3 We strive to provide same-day service when requests are received before 12:00 PM CST. Service timelines are estimates and not guarantees.
  • 3.4 Customer is responsible for providing accurate service location information, including a valid street address, access instructions, and contact information. Failure to provide accurate information may result in delayed service or additional charges.
  • 3.5 Customer must ensure the service location is accessible by our vehicles and equipment. Additional charges may apply for locations requiring specialized access, excessive manual labor, or extended loading times beyond 30 minutes.

4. Pricing & Payment Terms

4.1 Pricing

  • Pricing for tire disposal, recycling, and transportation services is based on tire volume, tire type, location, and pickup frequency. Quotes are provided upon request and are valid for seven (7) calendar days unless otherwise stated.
  • Pricing for tire casing purchases is based on casing size, condition, and current market rates at the time of inspection. Casing prices are determined at the point of inspection and are non-negotiable after payment has been issued.
  • Pricing for used commercial tire sales is based on tire size, tread depth, and current wholesale market conditions. All sales prices are quoted at the time of order.
  • We reserve the right to adjust pricing at any time without prior notice for new orders. Existing contracts with fixed pricing terms will be honored for the duration of the contract period.

4.2 Payment Methods

We accept the following payment methods:

  • On-Site Payment: Cash, check, and debit/credit card payments collected at the time of service. A receipt is provided at the point of transaction.
  • Online Payment: Credit card, debit card, and electronic payment methods processed through our secure payment platform.
  • Invoiced Payment (Commercial Accounts): Net 30 payment terms are available for qualified commercial customers with approved credit. Net 30 terms require a signed service agreement and credit approval.

4.3 Payment Obligations

  • All services rendered are due and payable upon completion unless a written Net 30 agreement is in effect.
  • For Net 30 accounts: Invoices are due within thirty (30) calendar days of the invoice date. Late payments are subject to a late fee of 1.5% per month (18% annually) on the outstanding balance, or the maximum rate permitted by Texas law, whichever is lower.
  • Returned checks are subject to a $35.00 returned check fee plus any bank fees incurred by the Company.
  • Accounts more than sixty (60) days past due may be referred to a collection agency. Customer agrees to pay all reasonable collection costs, including attorney's fees, incurred in collecting past-due amounts.
  • Customer acknowledges that services involving tire disposal, recycling, and transportation are performed immediately upon pickup and cannot be reversed, returned, or undone. Once tires have been collected from your location, the service is considered fully performed.

4.4 Chargebacks & Payment Disputes

  • Initiating a chargeback or payment dispute for services that have been rendered constitutes a breach of these Terms. Tire disposal, recycling, and transportation services are fully performed at the time of tire pickup. Casing purchases are final upon inspection, acceptance, and payment at your location.
  • If you believe there is an error with a charge, you must contact us directly at (832) 864-7067 or cashstirerecycling@gmail.com within seven (7) business days of the charge to resolve the issue. We are committed to resolving legitimate billing disputes promptly and fairly.
  • If a chargeback is filed after services have been rendered and documented, Customer agrees to pay the original amount due plus a $50.00 chargeback processing fee, all chargeback fees assessed by the payment processor, and any reasonable costs incurred by the Company in disputing the chargeback.
  • We maintain GPS-stamped service records, signed pickup receipts, photographs of tires collected, waste tire manifests, and driver logs for all services performed. This documentation will be presented as evidence in any chargeback dispute.
  • Repeated or fraudulent chargebacks may result in termination of service, reporting to credit agencies, and pursuit of legal remedies available under Texas law.

5. Tire Casing Purchases (We Buy Casings)

  • 5.1 Inspection & Acceptance: All casings are inspected on-site by our crew at the time of pickup. Casings are evaluated for tread depth, sidewall condition, bead integrity, and internal damage. Only casings that meet our retreadability standards will be purchased.
  • 5.2 Pricing: Casing purchase prices are quoted at the time of inspection and are based on size, condition, brand, and current market rates. Prices are subject to change without notice for future transactions.
  • 5.3 Payment: Payment for accepted casings is made on the spot at the time of pickup — cash or check at Customer's preference. Payment constitutes final acceptance and transfer of ownership of the casings to Cash's Tire Recycling Inc.
  • 5.4 Rejected Casings: Casings that do not meet our quality standards will be rejected. At the Customer's request, rejected casings may be disposed of through our tire disposal service at applicable disposal rates, or left at the Customer's location at no charge.
  • 5.5 Title Transfer: Upon payment, full title and ownership of purchased casings transfers to Cash's Tire Recycling Inc. Customer warrants that they are the lawful owner of the casings and have the legal right to sell them.
  • 5.6 No Guarantee of Purchase: Contacting us about selling casings does not guarantee that we will purchase any or all of your casings. Purchase decisions are made at the sole discretion of our inspection crew based on casing quality and current inventory needs.

6. Used & Retreaded Tire Sales

  • 6.1 Product Condition: All used and retreaded (recap) tires are sold "as-is" at the time of delivery or pickup. We inspect all tires before sale and certify that they meet minimum safety standards, but tires are pre-owned products with inherent variability.
  • 6.2 DOT Compliance: Retreaded tires sold by Cash's Tire Recycling Inc are retreaded by certified facilities and meet applicable Department of Transportation (DOT) safety standards for commercial vehicle use.
  • 6.3 Warranty: Used and retreaded tires are sold WITHOUT WARRANTY, express or implied, including without limitation any implied warranty of merchantability or fitness for a particular purpose, to the maximum extent permitted by Texas law. Tire performance depends on vehicle condition, load, driving habits, road conditions, and proper maintenance — factors outside our control.
  • 6.4 Returns: Due to safety, liability, and regulatory concerns, all tire sales are FINAL. No returns, refunds, or exchanges will be issued once tires leave our facility or are delivered to the Customer's location. If you receive a tire that is materially different from what was ordered (wrong size, obvious defect not disclosed at time of sale), you must contact us within 48 hours of delivery for resolution.
  • 6.5 Wholesale Orders: Wholesale orders of 100+ tires are subject to separate wholesale terms, which will be provided in a written wholesale agreement. Wholesale pricing, volume commitments, and delivery schedules are negotiated on a per-customer basis.
  • 6.6 Customer Responsibility: It is the Customer's sole responsibility to ensure that purchased tires are appropriate for their intended vehicle, load, and application. Cash's Tire Recycling Inc provides tire specifications upon request but does not provide fitment advice or installation services.

7. Hazardous Materials & Environmental Disclaimer

  • 7.1 Waste Tires Only: Cash's Tire Recycling Inc accepts ONLY waste tires (whole tires, shredded tires, and tire-derived materials). We do NOT accept hazardous waste, toxic materials, chemicals, medical waste, asbestos-containing materials, contaminated soil, or any material classified as hazardous under RCRA (Resource Conservation and Recovery Act), CERCLA (Superfund), or Texas Health & Safety Code Chapter 361.
  • 7.2 Customer Responsibility: Customer represents and warrants that all tires presented for disposal, recycling, or sale are free from hazardous contamination and have not been used to store, contain, or transport hazardous substances. Customer is solely responsible for ensuring that materials presented to Cash's Tire Recycling Inc consist exclusively of waste tires.
  • 7.3 Contaminated Materials: If tires are found to be contaminated with hazardous materials, petroleum products (other than normal tire residue), chemicals, or other non-tire waste, Cash's Tire Recycling Inc reserves the right to: (a) refuse the material, (b) return contaminated material to Customer at Customer's expense, (c) arrange for proper hazardous waste disposal at Customer's expense, and (d) report the incident to TCEQ and/or EPA as required by law.
  • 7.4 Indemnification: Customer agrees to indemnify, defend, and hold harmless Cash's Tire Recycling Inc, its owners, officers, employees, agents, and contractors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to the presence of hazardous materials in tires or other materials provided by Customer.
  • 7.5 Environmental Compliance: Cash's Tire Recycling Inc processes all waste tires in accordance with TCEQ regulations and maintains all required environmental permits, insurance, and financial assurance. We do not operate a landfill and do not dispose of tires in landfills. All tires are recycled into beneficial end products or processed as tire-derived fuel.

8. Service Area

Our primary service area includes the greater Houston metropolitan area and surrounding communities, including but not limited to Houston, Huffman, Kingwood, Humble, Atascocita, Spring, Baytown, Pasadena, Conroe, and Beaumont, Texas. Transportation and hauling services may be available statewide for qualifying wholesale volumes. Service availability outside our primary area is subject to minimum volume requirements and scheduling. Additional mileage or transportation charges may apply for locations outside Harris County.


9. Cancellation & Rescheduling Policy

  • 9.1 Customers may cancel or reschedule a service appointment by contacting us at least two (2) hours prior to the scheduled service time at no charge.
  • 9.2 Cancellations made less than two (2) hours before the scheduled service, or "no-shows" where our crew arrives and is unable to perform the service due to Customer's actions or omissions (locked gate, incorrect address, no authorized person present), may result in a trip charge of up to $75.00.
  • 9.3 For commercial contract customers with recurring scheduled service, cancellation of the contract requires thirty (30) days written notice. Early termination fees may apply as specified in the individual service agreement.

10. Limitation of Liability

  • 10.1 TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, CASH'S TIRE RECYCLING INC, ITS OWNERS, OFFICERS, EMPLOYEES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE SERVICES PROVIDED, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF USE, BUSINESS INTERRUPTION, OR PROPERTY DAMAGE, REGARDLESS OF THE THEORY OF LIABILITY.
  • 10.2 THE TOTAL LIABILITY OF CASH'S TIRE RECYCLING INC FOR ANY CLAIM ARISING OUT OF OR RELATED TO SERVICES PROVIDED SHALL NOT EXCEED THE AMOUNT PAID BY CUSTOMER FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM.
  • 10.3 Cash's Tire Recycling Inc is not liable for any damage to Customer's property (including driveways, landscaping, or structures) resulting from the normal operation of our vehicles and equipment during tire pickup and delivery, unless such damage is caused by gross negligence or willful misconduct.
  • 10.4 Cash's Tire Recycling Inc is not liable for any claims arising from the Customer's use, resale, or installation of used or retreaded tires purchased from us. Customer assumes all risk associated with the use of pre-owned tire products.
  • 10.5 Cash's Tire Recycling Inc is not responsible for tires left at the Customer's location after a scheduled pickup due to access issues, safety concerns, or tires not matching the description provided by Customer.

11. Indemnification

Customer agrees to indemnify, defend, and hold harmless Cash's Tire Recycling Inc, its owners, officers, employees, agents, and contractors from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees and court costs) arising out of or relating to:

  • Customer's breach of these Terms or any separate service agreement
  • Customer's violation of any applicable law, regulation, or ordinance
  • Any misrepresentation by Customer regarding the nature, condition, or ownership of tires or materials provided to Cash's Tire Recycling Inc
  • Presence of hazardous materials, non-tire waste, or contaminated materials in tires provided by Customer
  • Any environmental contamination, cleanup costs, or regulatory fines arising from materials provided by Customer
  • Customer's use, resale, or installation of used or retreaded tires purchased from Cash's Tire Recycling Inc
  • Any personal injury or property damage claims arising from Customer's use of tires purchased from Cash's Tire Recycling Inc

12. Intellectual Property

All content on our website — including text, images, logos, graphics, videos, and software — is the property of Cash's Tire Recycling Incor its licensors and is protected by copyright, trademark, and other intellectual property laws. The "Cash's Tire Recycling" name, logo, and related marks are trademarks of Cash's Tire Recycling Inc. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise use any content from our website without our prior written consent.


13. Website Use & User Accounts

  • 13.1 Our website is provided for informational purposes and to facilitate service requests. You agree to use the website only for lawful purposes and in accordance with these Terms.
  • 13.2 If you create an account on our customer portal, you are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized access to your account.
  • 13.3 You agree not to: (a) use the website to transmit spam, malware, or other harmful content; (b) attempt to gain unauthorized access to our systems; (c) use automated tools to scrape, crawl, or extract data from our website without our consent; or (d) impersonate any person or entity in communications with us.
  • 13.4 We reserve the right to suspend or terminate your access to the website or customer portal at any time, for any reason, without notice.

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to the personal jurisdiction of such courts.


15. Dispute Resolution & Arbitration

  • 15.1 Informal Resolution: Before initiating any formal dispute resolution process, you agree to first contact us at (832) 864-7067 or cashstirerecycling@gmail.com to attempt to resolve the dispute informally. Most issues can be resolved through direct communication.
  • 15.2 Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the services provided by Cash's Tire Recycling Inc that is not resolved through informal negotiation within thirty (30) days shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall be conducted in Harris County, Texas, before a single arbitrator.
  • 15.3 Class Action Waiver: YOU AGREE THAT ANY DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS AND NOT AS PART OF A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive the right to participate in a class action lawsuit or class-wide arbitration against Cash's Tire Recycling Inc.
  • 15.4 Small Claims Exception: Either party may bring an individual action in small claims court in Harris County, Texas, for disputes within the court's jurisdictional limits.
  • 15.5 Injunctive Relief: Nothing in this section shall prevent Cash's Tire Recycling Inc from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property rights or prevent irreparable harm.

16. Insurance & Bonding

Cash's Tire Recycling Incmaintains commercially reasonable insurance coverage, including general liability insurance, commercial auto insurance, workers' compensation insurance, and environmental liability coverage as required by TCEQ regulations and Texas law. Proof of insurance is available upon request for commercial customers.


17. Force Majeure

Cash's Tire Recycling Inc shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, severe weather (including hurricanes, flooding, and tropical storms common to the Houston area), pandemics, government actions, regulatory changes, labor disputes, equipment failures, supply chain disruptions, or civil unrest.


18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.


19. Entire Agreement

These Terms, together with our Privacy Policy and any separate written service agreements or contracts between the parties, constitute the entire agreement between you and Cash's Tire Recycling Inc regarding the subject matter herein. These Terms supersede all prior or contemporaneous oral or written agreements, representations, or understandings. No modification of these Terms shall be effective unless made in writing and signed by an authorized representative of Cash's Tire Recycling Inc.


20. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website with an updated "Last Updated" date. For material changes that affect existing commercial contracts, we will provide thirty (30) days' written notice to affected customers. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
